What can I do if my subsidy application is rejected?

You can lodge an objection to the decision with the administrative body that rejected the subsidy. One of our lawyers can help you draft a reasoned objection and, if necessary, lodge an appeal with the court.

Can a subsidy that has been granted be reclaimed?

Yes, for example if the conditions are not met or if the subsidy is withdrawn. In doing so, the government must observe the principles of good governance, such as due care, transparency and proportionality.

What happens after I have applied for a subsidy?

The administrative body assesses the application against the criteria set out in the scheme and then decides whether to grant or reject it. The administrative body then draws up a decision and may impose conditions or obligations that the subsidy recipient must comply with.

Who can apply for a subsidy?

Depending on the subsidy scheme being applied for, individuals, companies, foundations, associations or government agencies can apply for a subsidy. Specific eligibility criteria often apply, such as legal form, size of the organisation or location of the project.

Can I make changes to my subsidy project during the term of the subsidy?

Yes, but changes often have to be approved in advance by the administrative body. These changes may concern, for example, the planning, scope of the project or budgeted costs. Without approval, subsequent payments may be refused or repayment may be demanded.

What happens if I do not comply with the subsidy conditions?

If conditions are not complied with, the administrative body may reclaim the subsidy, partially withdraw it or impose sanctions, such as a fine. This may also have consequences for future applications.
